These Terms govern your use of leadhole.com and your participation in the Lead Hole pay per call network as a publisher or traffic partner. By applying to the network, accepting a campaign, or sending traffic to any tracking number we assign to you, you agree to these Terms.
If you do not agree to them, do not send traffic to our campaigns.
1. Publisher Accounts
Publisher accounts are granted at our discretion following review of your application. You must provide accurate information when you apply and keep it current, including your payment details and contact information.
You are responsible for the security of your account and for all activity that takes place under it. Accounts are not transferable without our written consent.
2. Campaign-Specific Requirements
Every campaign has its own requirements. These vary by vertical, service type, geographic area, permitted traffic sources, minimum call duration, caller intent and other qualification criteria.
Campaign requirements are published before you send traffic. It is your responsibility to review the requirements of each campaign you join and to follow them. Requirements may be updated; where they are, the version in effect at the time a call is placed is the version that applies to that call.
3. Approved Traffic Sources
You may only use the traffic sources and advertising methods permitted by the campaign you are promoting. Restricted and prohibited sources differ from campaign to campaign, so approval on one campaign does not carry over to another.
Traffic generated through a source that is not approved for that campaign may be rejected, and calls from it may be treated as non-billable.
4. Call Quality Standards
4.1 Invalid and fraudulent calls
You may not generate or submit calls that are fake, fraudulent, automated, manipulated, incentivised, duplicated, test calls, prank calls, or invalid in any other way. This includes any attempt to manipulate call duration, caller intent, tracking, attribution or reporting in order to create a billable call.
4.2 Calls outside campaign scope
Calls that fall outside the approved service requirements of a campaign may be rejected as invalid and will not be paid.
By way of example, where a campaign requires callers seeking a specific service, deliberately routing callers who only want to purchase a product or a part is outside the scope of that campaign, and those calls may be rejected.
4.3 Misrepresentation to callers
You may not mislead, misrepresent, manipulate or pressure a caller, and you may not provide false or deceptive information or incorrectly guide a caller in order to generate a billable call.
Your advertising must accurately describe the service being offered. Callers must understand what service they are calling about and must be calling of their own genuine intent.
5. Responsibility for Your Traffic
You are responsible for all traffic submitted under your account, and for the conduct of every party involved in generating it — your traffic sources, advertising methods, employees, contractors, affiliates, sub-publishers and any sub-network you operate.
If you work with other publishers beneath your account, you remain the responsible party for their traffic quality and compliance. Breaches by a sub-publisher are treated as breaches by you.
6. Call Tracking, Recording and Quality Assurance
Calls placed through tracking numbers assigned to you are tracked, and may be recorded and reviewed for call validation, quality assurance, dispute resolution and compliance purposes. Recordings and call data may be shared with the buyer receiving the call.
You are responsible for ensuring that your own advertising, landing pages and call handling comply with the requirements that apply to your traffic sources and to the jurisdictions you advertise in.
Our tracking records are the reference used to determine call validity, attribution and payable balances.
7. Warnings and Termination
We operate a single-warning policy. It is set out here in full so there is no ambiguity about how enforcement works.
7.1 Conduct that may result in a first written warning
At our discretion, we may issue a first written warning where we identify any of the following:
- a call that is fake, fraudulent, automated, manipulated, duplicated, incentivised, or a prank or test call, or that is invalid on any other basis
- a call generated for an irrelevant service, or otherwise outside the approved scope of the campaign
- a call generated through deliberately misleading information, or by misleading or incorrectly guiding a caller in order to create a billable call
A written warning will identify the issue and the corrective action expected of you.
7.2 The first warning is the only warning
Where a first warning has been issued, no second warning will be given. If a further violation occurs after that warning, we may immediately and permanently suspend or terminate your publisher account.
7.3 Immediate action without a warning
A warning is issued at our discretion and is not guaranteed in every case. Where we identify serious fraud, intentional manipulation of calls, traffic or tracking, unlawful activity, or a severe compliance breach, we may suspend or terminate your account immediately and without issuing a prior warning.
7.4 Effect on payouts
In addition to suspension or termination, we may withhold, cancel, deduct or recover payouts associated with calls that are invalid, fraudulent or otherwise non-compliant, including amounts already reported or already paid.
8. Account Suspension, Restriction and Termination
We may suspend, restrict or terminate a publisher account for compliance concerns, fraud concerns, invalid traffic, breach of campaign rules, payment disputes, or other legitimate business reasons.
Where an account is suspended pending investigation, campaign access and pending balances may be held until the review is complete.
9. Payment Terms
Publisher payouts are scheduled for the 15th of every month, covering the payable balance from the previous period.
Payment processing may be delayed by up to three additional calendar days beyond that date, but should not normally exceed that period.
Before a balance becomes payable, calls remain subject to validation, reconciliation, buyer confirmation, fraud checks, disputes and campaign requirements.
A call appearing in your reporting is not a guarantee of payment. Calls later determined to be invalid or non-billable will not be paid.
You are responsible for providing accurate payment details and for any taxes or fees that apply to you.
10. Non-Billable Calls
Calls that do not meet campaign requirements, or that are fraudulent, fake, duplicated, manipulated, outside campaign scope, or otherwise invalid, are non-billable and will not be paid.
11. Payout Adjustments and Withholding
Where calls are later determined to be invalid, fraudulent, duplicated, disputed, non-billable or in breach of campaign requirements, we may adjust, deduct or withhold the associated payout, including from a balance that has already been reported.
Where payment has already been made on such calls, we may offset the amount against future balances or seek recovery of it.
12. Reporting of Fraudulent or Unlawful Activity
Where we identify activity we reasonably believe to be fraudulent, deceptive or unlawful, we may report that activity to the relevant authorities, or to the appropriate government or regulatory body, in your jurisdiction or in any other jurisdiction where it is appropriate to do so.
Where legally appropriate, we may provide those authorities with the relevant account records, call records, call recordings, traffic information, payment records and other evidence relating to the matter.
We may also pursue any legal remedies available to us, including recovery of amounts paid on calls later determined to be fraudulent.
13. Changes to These Terms
We may update these Terms as our campaigns, buyers and obligations change. When we do, we will revise the Last Updated date at the top of this page. Continuing to send traffic after an update means you accept the updated Terms.
